Adrian Wong and Ho Hua Chyi from the Commercial Litigation Practice Group acted successfully against a self-styled “whistle blower” that had repeatedly defamed his former employer after he was terminated for consistently poor work performance. The High Court found that after his employment was terminated, the disgruntled employee went on a witch-hunt to smear the good name of his former employer, one of the top security services provider in Singapore, by writing to numerous government agencies to complain about the employer’s performance at its security assignments and its operations. In finding that the employee could not prove that his defamatory statements were true nor prove that he had acted altruistically in sending out at least 15 letters against his former employer, the High Court awarded aggravated damages totalling S$150,000 in favour of the employer and 2 senior management staff who were defamed by and had sued the “whistle blower”. This is believed to be the first case in Singapore where a former employee / “whistle blower” has been found liable for defamation and ordered to pay substantial damages.Date of Story:29 September 2009
